Kollam Bishop Stanley Roman injuncted by Kollam Court from spending funds and selling properties March 28, 2018

The Additional Munsiff Court in Kollam passed an order restraining the Bishop of the Kollam Latin Catholic Diocese, Stanley Roman, from taking policy decisions with respect to spending funds, sale of diocesan properties and transferring priests and other staff of the institutions under the diocese.
The order, which has similarities with the legal restrictions imposed on Syro-Malabar Church head Cardinal George Mar Alencherry in the land row case related to the Ernakulam-Angamaly Archdiocese, was pronounced by additional munsiff Jyothi Babu R on a petition filed by members of the Church Act Action Council on Saturday. The Munsiff, however, said that the order shall not in any way restrain the Bishop from performing his religious functions.

The petitioners, Thankachan L and Hillary Zacharia, submitted before the court through Adv Ramesh Kumar that the Bishop had sold the property of the diocese at Kottiyam and leased out another property in Kollam city. They alleged that there are plans to sell more diocesan properties and withdraw huge amounts from the bank accounts of the diocese.

The petitioners also submitted that the bishop, who is above 75 years of age, is only a caretaker of the diocese under the Canon Law.

The bishop, in his submission, said the allegations raised by the petitioners were ‘cooked up’ in order to cover up their illegalities. One of the petitioners is a teacher at a school under the management of the diocese, he said.
The ulterior motives include amassing huge contributions from persons interested in developing hatred against the Catholic Church, the bishop said.
The Additional Munsiff, in her order, said that since the Bishop has crossed the age of 75, he has a moral obligation not to take any policy decisions and thereby he should be precluded from taking such policy decisions.
The order also stated that the apprehension of the petitioners can be concluded as genuine as they have a right to protect the interests of the community as the properties of the diocese are for the welfare of the community at large. The court concluded that the petition has a prima facie case and hence the bishop is restrained.

The allegations against this Bishop are so grave and amounts to discrepancy of crores of rupees. The Kollam West Police had already registered a criminal case with Bishop Stanley Roman as 2nd accused wherein it is alleged that the Attendance Register of St Aloysius Higher Secondary Schools was tampered with criminal motive to somehow avoid the promotion of a teacher. The Kollam West Police have also questioned the Bishop on a complaint submitted to the Chief Minister of Kerala which was forwarded to the Police wherein the allegations relate to large scale land deals causing huge loss to the Diocese.

The Church Act Action Council has called upon the Diocesan members to join them to put pressure on the Government to pass the proposed law “The Kerala Christian Church Properties and Institutions Trust Bill” prepared and submitted by the Law Reforms Commission headed by Justice V.R.Krishna Iyer. This law alone could act as a lawful obstruction to the illegalities being committed by these type of Bishops, the Council Office bearers said.

The laymen of Kollam Diocese gathered at Ferns Hall, Kollam on 4-2-2018 to protest against the authoritarian and arbitrary behaviour of Rev Stanley Roman, Bishop of Kollam. The meeting was presided by Christopher G. The introductory speech was delivered by Adv Boris Paul who narrated the incidents of the authoritarian style of functioning of Rev Stanley Roman. He exhibited documents proving the manner in which the Bishop sold property worth Rupees Eight Crores for a mere Rupees One Crore to a stranger. This property and various other properties were sold to strangers by Rev Stanley Roman without informing the laymen or without any publication regarding sale. The secrecy maintained in the transactions create serious doubts about the manner in which the properties were sold away.

Another revelation made in the meeting was with respect to a huge liability created by this Bishop in the functioning of an Engineering College at Kollam. The liability towards the Bank by way of loans is assessed as about Rs.56 Crores. Loans from individuals amount to about Rs.2 Crores. Loans from institutions amount to about Rs.11 Crores. It is also doubtful  as to why such a huge liability was created upon the Diocese, that too without the knowledge of the laymen.

Yet another case of forgery and manipulation in Revenue Records were also revealed whereby 2 Acres of Government Land was allocated in the name of Bishop of Kollam in the official records by forgery and thereafter the said Government land was sold as various plots to several persons. The case registered by the Government is being delayed by adopting manipulation and tactics.

The meeting was inaugurated by Placid G.Mukkad, Editor of Bharatha Vimochanam. Theophilus Anjelose led the discussion. Thankachan, Augustin Pereira, Felix Babu (Ferns), Ephrem Koduvila, Bastian Pattakadavu, Nixon Thangasseri, Joy Augustin, Neythil Vincent etc particpated.

The meeting decided to form an action council for the implementation of the proposed law for Church properties and Institutions. The law proposed and drafted by the Law Commission headed by Justice V.R.Krishna Iyer is the only solution for such lawlessness among the Bishops, decided the meeting. The Council will also proceed legally against the irregularities committed by the Bishop of Kollam.

CHURCH ACT ACTION COUNCIL was declared with Christpher G as its President and Ignatius Robert as its Secretary. The other office bearers will be announced shortly. The Patrons are Felix Babu, Placid G.Mukkad, Theophilus Anjelose, E.K.Bosewell, Augustin Pereira and Selastin Disamas.

Movement against arbitrary deals of Kollam Bishop January 23, 2018

The members of Kollam Diocese have waken up to a call for a crusade against the arbitrary manner in which the properties owned by the Diocese of Kollam was sold out to strangers by Rev Stanley Roman, Bishop of Kollam. It has been revealed from a facebook post by Adv Boris Paul that the Diocese is in a debt trap of about 80 Crores which includes Bank Loans and Loans from Institutions as well as individuals. In a disclosure made in a facebook post, Adv Boris Paul published a copy of the sale deed executed by the Power of Attorney of Rev Stanley Roman during 2011 by which he sold a prime plot at Thangassery near the Bishop’s House having an extent of 107 cents for a meagre sum of about Rupees One Crore. It is said that the property was actually sold for Rupees Eight Crores. The Diocesan members are in the dark about the actual transaction. The difference in amount is huge and it is unknown as to where this amount has gone. The purchaser later sold it to another person for more than Rupees 10 Crores.

In another disclosure, it is known that two acres of government puramboke land in Adichanelloor Village was illegally transferred to the name of Kollam Bishop by manipulating Revenue Records in the Village Office and it was sold to many persons by the Bishop. A proceedings against the Bishop is kept pending before the Government for long years.

The members have formed a society named CHURCH ACT ACTION COUNCIL in a meeting conducted on 19-01-2018 at Kollam and decided to move legally against the Bishop and his accomplices and also to put pressure upon the Government to pass the proposed Bill on Christian Church Properties and Institutions which was drafted and submitted by the Law Reforms Commission headed by Justice V R Krishna Iyer.

The Judicial I Class Magistrate Court-II granted bail to Fr Lazar Pattakadavu in a defamation case filed by the office bearers of Pullichira Edavaka Samrakashana Samithi. The priest had approached the honourable High Court of Kerala to get the criminal case against him quashed, but the prayer was rejected by the High Court. The priest and other accused had published defamatory statements defaming the office bearers of Pullichira Edavaka Samrakshana Samithy. The priest and co accused surrendered before the Judicial I Class Magistrate’s Court -II, Kollam and sought bail which was granted on executing bond.

KOLLAM: A march led by Kureepuzha church parishioners protesting against the Kollam Bishop’s decision to transfer the church vicar turned violent here on Sunday.

Police personnel resorted to lathicharge and fired teargas shells to disperse the protesters after they pelted stones at police personnel. Over 40 protesters and five policemen were injured in the melee.

Many, including women, fainted after the police fired teargas shells to disperse the mob. Mediapersons were injured in the stone pelting. The incident took place around 12 pm. A group of over 500 parishioners took out a protest march against Bishop Stanley Roman’s decision to transfer Joseph Daniel, the vicar of Kureepuzha church, as part of reforms in the diocese.

The group which marched from Altharamoodu was stopped by the police around 100 metres in front of the Bishop’s House at Thangassery. Then then staged a sit-in, demanding reversal of the Bishop’s direction.

Two representatives from the Bishop’s House, who held talks with the protesters explained that the transfer was a routine one and the decision can’t be reversed.

It was after this that the mob turned violent. “We are carrying a routine procedure, which usually is done during this time of the year. We think that many of the protesters are not church-going people and they have deliberately instigated the incident to create unrest among believers in the diocese,”  said a member of Bishop’s House.

He also added that to question the transfer is like questioning the Bishop and as the vicar himself had accepted this transfer, there is no meaning in the protest.

The situation was brought under control after Labour Minister Shibu Baby John held talks with the protesters.

കൊല്ലം: പുല്ലിച്ചിറ ഇടവക സംരക്ഷണ സമിതി സെക്രട്ടറി അഗസ്റ്റിനെതിരെ ഇടവക വികാരി ഫാ. ലാസർ പട്ടകടവ് ബോധിപ്പിച്ച മാനനഷ്ട കേസ് തള്ളി പ്രതിയെ വെറുതെ വിട്ടുകൊണ്ട് കൊല്ലം ചീഫ് ജുഡീഷ്യൽ മജിസ്ട്രേറ്റ് അജിത കെ.ഹസൻ വിധി പ്രസ്താവിച്ചു. പുല്ലിച്ചിറ ഇടവക വികാരി ആയിരുന്ന ഫാ. ലാസർ പട്ടകടവിനെതിരെ നിരവധി കേസുകൾ കൊല്ലം കോടതികളിൽ നടത്തിവരുന്ന ഇടവക സംരക്ഷണ സമിതിയുടെ സെക്രട്ടറി അഗസ്റിൻ കൊല്ലം മുൻസിഫ്‌ കോടതിയിൽ ബോധിപ്പിച്ച ഒരു സത്യവാങ്ങ്മൂലത്തിൽ വികാരിയെ അപകീർത്തിപ്പെടുത്തുന്ന പ്രസ്താവനകൾ നടത്തി എന്നായിരുന്നു കേസ്. ഇത് മൂലം സമൂഹത്തിൽ തന്റെ വിലയിടിഞ്ഞു എന്ന് വികാരി കോടതിയിൽ മൊഴി നൽകി. സാമൂഹ്യ വിരുദ്ധരെയും അഴിമതിക്കാരെയും സ്വാധീനിച്ചു പള്ളിയുടെ ഫണ്ട് ദുർവിനിയോഗം ചെയ്യാനായി വികാരി പ്ലാനും പദ്ധതികളും തയ്യാറാക്കി എന്നും വിശുദ്ധ പാത എന്ന പേരിൽ 23 ലക്ഷം രൂപ ചെലവാക്കി പള്ളിയുടെ പടിഞ്ഞാറ് ഭാഗത്ത്‌ കായലിലേക്ക് വീതിയുള്ള ഒരു നടപ്പാത കെട്ടിയെന്നും, ആയതിനു 5 ലക്ഷം രൂപയിൽ താഴെ മാത്രമേ ചെലവായിട്ടുള്ളൂ എന്നും മറ്റും സത്യവാങ്ങ്മൂലത്തിൽ എഴുതി കോടതിയിൽ ഹാജരാക്കി അഭിഭാഷകനെ കൊണ്ട് വാദം നടത്തിയെന്നും അത് കേട്ട അഭിഭാഷകരുടെയും കക്ഷികളുടെയും ഇടയിൽ തന്റെ സൽപ്പേര് കളങ്കപ്പെട്ടു എന്നും ആയിരുന്നു വികാരിയുടെ കേസ്. ഇംഗ്ലീഷിൽ കോടതിയിൽ സമർപ്പിച്ച സത്യവാങ്ങ്മൂലതിന്റെ തെറ്റായ പരിഭാഷ ഉപയോഗിച്ചാണ് വികാരി കേസ് ബോധിപ്പിച്ചതെന്ന പ്രതിഭാഗം വാദം ശരിയെന്നു കോടതി കണ്ടെത്തി. അപമാനകരമായ പ്രസ്താവന പരാതിയിൽ അതേപടി പകർത്തണം എന്ന നിയമ വ്യവസ്ഥ ഈ കേസിൽ ലംഘിച്ചതായും കോടതി കണ്ടെത്തി. വികാരിയുടെ ഇഷ്ടപ്രകാരം ഉള്ള തർജമ മാത്രമാണ് പരാതിയിൽ ഉള്ളത് എന്ന് വിധിയിൽ കോടതി പരാമർശിച്ചു. ഇടവക സംരക്ഷണ സമിതിയുടെ സെക്രട്ടറി എന്ന നിലയിൽ ആണ് അഗസ്റിൻ കോടതിയിൽ സത്യവാങ്ങ്മൂലം സമർപ്പിച്ചതെന്നും വ്യക്തിപരമായല്ലെന്നും കണ്ടെത്തിയ കോടതി പരാതിക്കാരനായ വികാരിക്ക് സമിതിക്കെതിരെ പരാതിയില്ലാത്ത സ്ഥിതിക്ക് അഗസ്റ്റിനെതിരെ മാത്രം പരാതി നിലനില്ക്കില്ലെന്നു വിധിച്ചു. തന്റെ സൽപ്പേര് കളങ്കപ്പെട്ടു എന്ന് തെളിയിക്കാൻ വികാരിയുടെ സാക്ഷികളായി കോടതിയിൽ ഹാജരാക്കി വിസ്തരിച്ച ജോർജ് സേവ്യർ, സോണൽ ലോറൻസ് എന്നിവരെ ക്രോസ് വിസ്തരിച്ചപ്പോൾ പരാതിക്ക് ആസ്പദമായ ആരോപണങ്ങൾ മൂലം വികാരിയെ കുറിച്ച് തങ്ങളുടെ മനസ്സിൽ ഒരു ഇടിചിലും ഉണ്ടായില്ല എന്നാണു മൊഴി നൽകിയത്. ഇക്കാരണത്താലും പ്രതിക്കെതിരെ വികാരിയുടെ മാനനഷ്ട കേസ് നിലനില്ക്കില്ല എന്ന് കോടതി വിധിയിൽ വ്യക്തമാക്കി. പൊതുജന മധ്യത്തിൽ വികാരിയുടെ സൽപ്പെരിനു ഇകഴ്ച ഉണ്ടായതായി തെളിവില്ലെന്ന് കണ്ടെത്തിയ കോടതി പ്രതിയെ വെറുതെ വിട്ടു വിധിച്ചു. പ്രതിക്ക് വേണ്ടി അഡ്വ. എം.ഐ.അലക്സാണ്ടർ പണിക്കർ, അഡ്വ. ബോറിസ് പോൾ എന്നിവർ കോടതി മുമ്പാകെ ഹാജരായി.

High Court directs speedy disposal of Prosecution Proceedings against Fr Lazar Pattakadavu January 24, 2013

Fr Lazar Pattakadavu, the erstwhile Parish Priest of Pullichira Parish is facing Prosecution proceedings for violation of the Order of Kollam Munsiff’s Court. The Secretary of Pullichira Edavaka Samrakshana Samithy had preferred a Petition for prosecuting the Priest and evidence was given before the Honourable Munsiff’s Court. When the case was posted for the examination of Fr Lazar Pattakadavu, the Priest had approached the Honourable High Court of Kerala for quashing the proceedings stating that it is not maintainable. A stay was granted initially by the Honourable High Court. During the final hearing, the Honourable High Court has declined to quash the prosecution proceedings and the Counsel for the Priest had to refrain from urging the contention. Now the High Court has directed the trial court to dispose the Prosecution Petition within three months. Adv Krishnamony appeared for the Secretary, Pullichira Edavaka Samrakshana Samithy before the Honourable High Court of Kerala. Adv M.I.Alexander Panicker, Adv Boris Paul & Adv G.Vijayakumar are appearing for the Secretary of Pullichira Edavaka Samrakshana Samithy in the trial Court.
