The President of Pullichira Edavaka Samrakshana Samithy, Mr Selastin Dismas has filed a Criminal Complaint against Fr Lazar S.Pattakadavu and his Church Committee Members before the Judicial I Class Magistrate’s Court-II, Kollam for offence of defamation committed by them. The alleged offence is punishable under Sections 499, 500 & 501 r/w Section 34 of Indian Penal Code. The Complaint was filed through Advocates Boris Paul, R.Rajendran & G.Vijayakumar. The Honourable Magistrate has taken the Complaint on file and posted it for recording the sworn statements of the Complainant and witnesses. The Committee Members of the Church had filed a Petition before the Kollam District Registrar against the Office bearers of the Pullichira Edavaka Samrakshana Samithy which contained wild, baseless and defamatory allegations. They went to the extent of defaming the Office bearers of the Samithy by stating that the District Registrar was misled to grant Registration by forgery and using forged documents etc. Even though the Priest was not a Petitioner in the said defamatory Petition, the cat came out of the bag when the Priest filed unnecessary Caveat Petitions against the Samithy before the Kollam Munsiff Court, Sub Court and District Court. In those Caveat Petitions, the Priest had categorically stated that he had filed the ‘Petition before the Kollam District Registrar’ against the Registration granted to the Samithy. In another Petition moved before the Honourable High Court of Kerala by the same Priest, it was reiterated that he had filed the ‘Petition before the Kollam District Registrar’ against the Registration granted to the Samithy. A Legal Notice was issued by the Office bearers of Pullichira Edavaka Samrakshana Samithy to Fr Lazar and his Committee Members as they publicised the defamatory Petition by circulating copies of the same among the public with intention to defame the Office bearers of Pullichira Edavaka Samrakshana Samithy. The Priest and his men had received the Legal Notice, but failed to issue any reply. The averments and allegations in the Legal Notice was not denied by the Priest and his men! The other Office bearers of the Samithy have also decided to file separate Complaints against the Priest and his men.
