Scheme Suit filed before District Court, Kollam August 28, 2010

A Civil Suit has been filed before the Kollam District Court for framing a Scheme for the better administration of Pullichira Parish. The Suit was filed by Mr Selastin Dismas, Mr C.R.Francis, Mr Francis & Mr N.S.Maryson. The Bishop of Kollam, Parish Priest & Kaikkaran are also arrayed as Respondents. The Honourable District Judge Shri Thomas Pallickaparambil has ordered notice to the Respondents. The Suit is filed through Advocates M.I. Alexander Panicker & Boris Paul.

The main reliefs sought in the Suit are:

a)     to settle a scheme for the better administration and management of the 1st Respondent Trust.

b)     to remove Respondents 2 to 5 from the status of Trustees from the 1st Respondent Trust.

c)      to appoint new Trustees for the assets of the 1st Respondent Trust.

d)     to direct enquiries of accounts for the period from 17-5-2005 of the 1st Respondent trust.

e)      to vest with the Trustees with all the properties and assets of the 1st Respondent Trust.

f)       grant such further or other relief as the nature of the case may require.

Bishop files Appeal! June 29, 2010

The Bishop of Kollam and the Parish Priest of Pullichira has filed separate Appeal Suits before the Kollam District Court against the Order of Injunction passed by the Munsiff’s Court, Kollam. They have challenged the Order of the Lower Court on various grounds. The Appeal is admitted and transferred to the Additional District Court, Kollam for hearing. The Honourable Court has issued notices to the Office bearers of Pullichira Edavaka Samrakshana Samithy. The Samithy has decided to engage Adv M.I.Alexander Panicker and Adv Boris Paul on their behalf. The Appeals are filed by Adv George Mathews on behalf of Kollam Bishop and Adv K.Reghu Varma on behalf of the Parish Priest.

Our Pamphlet has received attention from important personalities in the field of human rights activities. Shri BRP Bhaskar has reproduced certain portions of our Pamphlet in his Blog. We are much thankful to him. The mainstream Newspapers like Malayala Manorama and Mathrubhoomi as well as Desabhimani refused to publish the news regarding the Court Order passed against the Bishop of Kollam and others.

Suit filed against INTERDICTS & CENSURES February 28, 2010

The Office bearers of Pullichira Edavaka Samrakshana Samithi who were served with INTERDICTS and CENSURES have filed a Civil Suit against the Bishop, Episcopal Vicar and Parish Priest before the Munsiff’s Court, Kollam. The Suit was filed through Advocates M.I.Alexander Panicker and Boris Paul. The Suit was filed seeking the following reliefs:

1) To pass a decree of declaration that the Orders passed by the Vicar in the form of  INTERDICTS and CENSURES are illegal, arbitrary and void and are in violation of the civil rights of the Plaintiffs and is unenforceable against Plaintiffs and or their family members.

2) To pass a decree of permanent injunction restraining the Defendants and their Pastors from doing any act to discriminate, obstruct, delay or deny the Sacraments and rites to the Plaintiffs and or their family members in lieu of the Plaintiffs forming the Charitable Society (Pullichira Edavaka Samrakshana Samithy) or any organisation and or criticising the Church authorities including the Defendants, or lodging any Complaints against the Defendants to authorities including Pope through legal means.

3) To allow cost of the Suit from the contesting Defendants.

The Bishop had filed Caveats through Adv George Mathews and therefore the Suit was filed after serving copies of the Suit and other documents to their Counsel. The matter will be heard on 1st March 2010.

We request all help from our well wishers to fight against the unchristian acts being committed by the Bishop of Kollam, Episcopal Vicar and the Parish Priest of Pullichira.
